Answers to Common Family Law Questions
Not every family law matter requires a lawyer, but getting legal advice early can help you understand your rights, obligations and options before making important decisions.
A family lawyer can be particularly helpful if you are dealing with parenting arrangements, child or spousal support, division of property or debt, a separation agreement, family violence, or a court proceeding.
Even if you hope to resolve matters amicably, legal advice can help you understand the legal and financial consequences of any agreement before you sign it.
Your initial consultation is an opportunity to tell us what is happening, identify your main concerns and discuss what you would like to achieve.
A lawyer will review the information you provide, explain the legal issues that may apply to your circumstances and discuss your options and possible next steps.
If you decide to retain Ali Legal, we will discuss the recommended strategy for moving your matter forward.
Not necessarily. Many family law matters can be resolved without a trial through negotiation, mediation or a written agreement.
Where an agreement cannot be reached, or where urgent court intervention is required, it may be necessary to start or continue court proceedings.
Our approach is to consider the circumstances of your case, your priorities and the available options, and develop a strategy for resolving your matter as effectively as possible.
Parenting arrangements are determined based on the best interests of the child. There is no automatic rule that parenting time must be divided equally between parents.
Depending on the circumstances, parenting arrangements may address where a child lives, parenting time, parental responsibilities and how important decisions concerning the child will be made.
The appropriate arrangement will depend on the particular needs and circumstances of the child and family.
Child support is generally determined under the applicable Child Support Guidelines. The amount can depend on factors including the paying parent’s income, the number of children and the parenting arrangement.
Parents may also be required to contribute to certain additional expenses, such as childcare, medical expenses or extracurricular activities.
Child support can become more complex where income is difficult to determine, a parent is self-employed, parenting time is shared, or a child’s circumstances create additional expenses.
Spousal support is not automatic. Whether a spouse is entitled to support depends on the circumstances of the relationship and separation.
If entitlement is established, the amount and duration of support may be influenced by factors including the length of the relationship, the parties’ incomes, their roles during the relationship, financial need and the economic consequences of the relationship and its breakdown.
The Spousal Support Advisory Guidelines may also assist in assessing an appropriate range of support.
Under British Columbia’s Family Law Act, spouses generally share family property and family debt when they separate, subject to the legislation and any applicable agreement or court order.
Some property may qualify as excluded property, including certain property owned before the relationship and some gifts and inheritances. However, increases in the value of excluded property may be treated differently.
Property division can become more complex where there are businesses, corporations, pensions, investments, real estate, trusts, inheritances or disputes about the value or ownership of assets.
The cost of a family law matter depends on its complexity, the issues in dispute, the amount of work required and whether the matter can be resolved by agreement or requires court proceedings.
At your consultation, we can discuss the issues involved in your case, the work that may be required and our retainer and billing arrangements.
Where possible, we work with clients to identify practical and proportionate ways of moving their matters forward.
Tell us a little about your situation and our team will contact you about arranging a consultation.
